Kentucky Security Deposit Demand Letter

Kentucky sets no deadline for returning a security deposit. Ky. Rev. Stat. § 383.580 imposes other duties on the landlord instead, and a landlord who skipped them can be on the hook for forfeiture of the landlord's right to keep any of the deposit. Does this statute apply to you?

Kentucky's Uniform Residential Landlord and Tenant Act is local-option. Under KRS 383.500 it governs only where a city, county or urban-county government has adopted KRS 383.505 to 383.705 in their entirety -- Louisville/Jefferson County and Lexington-Fayette County among them, but not the state as a whole. Outside an adopting jurisdiction Kentucky has no security deposit statute, and the lease and common law govern instead.
